DEFINITIONS

"Customer (s)" means the Internet user (s) browsing the Site and making an online purchase of product (s) for personal purposes. "General Conditions of Sale" means these general conditions of sale of Products on the Site. "Figaret Paris" means Comptoir Français De La Chemise (SIRET No. 552 095 234 00316) whose head office is located at 63 avenue de Villiers, 75017 Paris - France, owner of the Figaret Paris brand and manufacturer of Figaret Products Bets sold on the Site. "Party (s)" alternatively or collectively designates Figaret Paris and / or the Customer (s). "Products" means the Products offered for sale on the Site under the conditions of Article 3 below. " Site ”designates the electronic commerce Internet site accessible via the Internet network: www.figaret.com where the sale of Figaret Paris brand products takes place.


PURPOSE – SCOPE OF THE GENERAL CONDITIONS OF SALE

The purpose of these general conditions of sale is to define the terms of the online sale of Products on the Site to Customers, as well as the rights and obligations of the Parties arising from the online sale of the Products offered on the Site.

They determine all the steps necessary for placing the order and ensure the follow-up of this order between the Parties.

By ordering a Product on the Site, the Customer acknowledges having read the General Terms and Conditions of Sale and accepted them without restriction, this acceptance not being in any way conditioned by a handwritten signature on the part of the Customer.

Consultation of the Site by the Customer is also governed by the terms of use of the Site that he accepts without reservation and can be accessed here: Legal Notice.

It is specified that the Customer can save or print these General Conditions of Sale, provided however that they do not modify them.

Figaret Paris reserves the right to update the General Conditions of Sale at any time.

The General Conditions of Sale apply to all online sales made on the Site to the exclusion of any other document, and in particular the conditions applicable for sales in stores or through other distribution and marketing channels.

PRODUCTS

Product description

The Products offered for sale are those which appear on the Site, on the day of consultation of the Site by the Customer, and within the limit of available stocks.

The greatest care is taken in the presentation of Products on the Site in order to meet the requirements of Article L.111-1 of the Consumer Code. However, the photographs illustrating the Products are only indicative and do not enter into the contractual field.

Indeed, if every effort is made to ensure that the color of the Products, the photos of which are displayed on the Site, are faithful to the original products, variations may occur; in particular because of the technical limitations of color rendering of computer equipment. Consequently, Figaret Paris cannot be held responsible for errors or inaccuracies in the photographs or graphic representations of the Products presented on the Site.

 

Product availability

The Products are offered within the limits of available stocks. There is no guarantee of availability of the Products presented on the Site. In the event of unavailability of one of the Products ordered by the Customer, the latter will be informed as soon as possible by email of the delivery of a partial order or of the cancellation of his order.

PRICE

The prices of the Products are firm and indicated in euros. The current rate is that indicated on the Site, except for typographical errors.

These prices take into account the VAT applicable on the day of the order. The default VAT rate displayed on the Site is that of France, it is updated when the country of delivery is selected in the basket. If the country of delivery is outside the European Union, no V.A.T. is applied by the Site, V.A.T. will then be payable to the delivery person upon receipt of the package (UPS is responsible for collecting V.A.T.). Any customs duties may be claimed depending on the country of delivery. In this case, the customer is responsible for paying the carrier for any customs duties at the time of delivery.

Product prices do not include delivery costs which will be invoiced in addition and will be specified to the Customer before the final validation of his order. The amount of transport costs is calculated in particular according to the requested delivery time and according to the terms defined by the carrier chosen on the Site.

The price invoiced to the Customer also indicated on the order confirmation sent by e-mail.

Figaret Paris reserves the right, which the Customer accepts, to modify its prices at any time, without any other formality than making the modifications on the Site. However, these modifications will not affect orders accepted by the Site before the entry into force of these modifications, subject to the availability of the Products ordered.

RETENTION OF OWNERSHIP

Ownership of the Products is transferred to the Customer only after full payment of the price by the latter.

ORDER TERMS

Navigation within the Site

The Customer can learn about the different Products offered for sale on the Site. The Customer can browse freely on the different pages of the Site, without being committed to an order.

Registration of the order

It is specified that the Products are intended for the personal use of the Customer, without any direct connection with the professional activity of this one. However, no restriction in terms of order quantity is imposed by Figaret Paris.

Delivery territory eligible for an order

The Customer may only order Products for delivery to the list of countries offered on the Site. Any order mentioning another place of delivery will be rejected.

Final validation of the order

The Customer must check the box opposite the message “I accept the general conditions of sale” to enter the payment details and definitively confirm his order.

Confirmation of an order

The sale will only be considered final after sending the Customer the confirmation of dispatch of the order by e-mail.

Reservation - Presale

When the Site offers products for reservation or presale, then the entire site invoices all products when ordered. Orders including products in reservation will be delivered from the date indicated on the product sheet concerned.

Cancellation possible within 14 days by contacting Customer Service. Size exchanges only possible in store within 14 days depending on available stock. Returns and refunds according to the online store procedure.

PAYEMENT

Unless the server is unavailable, the Customer may pay for his order after final validation of it on the Site, by Credit Card (Carte Bleue, Visa, Mastercard, Amex exclusively). The Customer will enter his card number, the expiration date of the card, the name of the card holder and the visual cryptogram (the last three numbers written on the back of his bank card). The customer also has the option of making payments via Paypal.

Payments by check are not accepted.

Figaret Paris reserves the right to refuse any order or any delivery in the event of an existing dispute with the Customer, total or partial non-payment of a previous order by the Customer, refusal of authorization of payment by bank card from organizations banking.

The Customer guarantees that he has the necessary authorizations to use the payment method chosen at the time of validation of the order. In case of refusal by the bank, the order will be automatically canceled and the Customer notified by sending an email.

The Customer is invited to print the summary of the order. Data relating to orders will be recorded and kept in the computer systems of Figaret Paris and its partner bank. The information registers of these companies will be considered as constituting proof of all transactions between the Parties on the Site. The archiving of order data is carried out on a reliable and durable medium that can be produced as evidence.

DELIVERIES 

Method of delivery

The products are delivered with a variable delay depending on the delivery method chosen and the country of destination. Exceeding these deadlines by the delivery provider may in no case give rise to any compensation for the benefit of the Customer. Any order placed before 12 noon, Monday to Friday (excluding public holidays), will be shipped the same day within the limits of available stocks.

To note :

Deliveries (all areas) for which the delivery address entered on the Site will always be excluded will be:

- a hotel or other accommodation centers

- a post office

- from an anonymous PO box

- a non-fixed address or domicile (that is to say, and without this list being exhaustive, mobile homes, caravans, campsites, and other non-fixed domiciliations) or in a collective place where a individual address cannot be clearly and durably assigned to a natural or legal person.

Packaging of the order

Orders are delivered in specific packaging to guarantee their condition during the transport of the Products. All orders are delivered with a delivery note corresponding to the Products delivered.

 The Customer must check the good condition of the products upon delivery. Any anomaly concerning the delivery (damaged packages, items missing from the Site invoice, late delivery, etc.) must be subject to reservations on the delivery receipt presented by the carrier. The Customer must also report this by e-mail in order to improve the quality of service that may be offered to him and to allow Figaret Paris to carry out an investigation with the carrier.

In the event that the Customer has reported a missing product, an investigation with the carrier may take up to 21 working days. If during this period the product is found, it will be immediately forwarded to the place of delivery designated in the order form.

On the other hand, if the ordered product is not found at the end of this period of 21 days of investigation, the Site will proceed at its expense to a new shipment of the missing products initially ordered by the Customer. After a period of 7 days following the scheduled delivery date and failing to comply with these formalities, the Products will be deemed to comply and free from any apparent defect and no claim can be validly accepted by the Site.

In the event of a lack of conformity of a delivered Product, the Customer may return it to Figaret Paris by following the standard return procedure, in its original condition, imperatively covered with the original labels and accompanied by the original packaging and of the return slip. Otherwise, Figaret Paris will not exchange or reimburse the returned defective Product.

In the event that the return of the defective Product is well founded, Figaret Paris will proceed, at the choice of the Customer, or in the absence of a request by the Customer at the choice of Figaret Paris, with the reimbursement of the defective Product or its exchange to the extent that this Product is available in stock, excluding any compensation. Under no circumstances can a return, exchange or refund be requested and / or made in the store.

RETURNS & REFUNDS

Terms of exchanges and refunds

Exchanges are not possible on the online store. The customer is encouraged to follow the standard return for refund procedure and place a new order to obtain the desired item.

Excluding sales and promotional offers, the customer has the option of exchanging the product purchased on our online store directly in the store (excluding corners and Outlets) for another item of his choice. If the exchange is for a product whose price is lower than the invoiced price, the customer will obtain a credit for the difference valid for 1 year (no credit may be issued during sales or promotional offers). If the exchange is for another product whose price is higher than the price of the item ordered, the customer will have to pay the difference.

During sales and promotional offers, the customer has the option of making a standard exchange of the item purchased from our online store directly in store for the same item in a different size.

Under no circumstances can an item ordered on the online store be refunded in the store unless the item was purchased via Pay & Collect. The customer has a maximum period of 14 days from the date of receipt of his package to go to the store. The customer also has the possibility of going to the store (within 14 days maximum following the date of receipt of his parcel) with his article and to request a credit for the amount of the article which will be valid for 1 year in the store.

For any refund, the customer is invited to follow the standard return procedure.

In the event that the return decision is the consequence of an error emanating from Figaret Paris, the return costs are the responsibility of the Site.

Return methods

In accordance with the provisions of article L.121-21-2 of the Consumer Code, the Customer has a maximum period of 14 clear days to exercise his right of withdrawal. This period starts from the day of delivery of the order.

The customer therefore has 14 days to return the Product (s) he has ordered if it (these) does not give him / her satisfaction, so that the order is reimbursed, including the duly completed return form.

The costs and risks of return are the responsibility of the Customer. The Site does not accept postage due packages.

However, in accordance with the provisions of article L.121-20-2 of the Consumer Code, this right of withdrawal is not applicable for the Product (s) made according to the Customer's specifications or clearly personalized.

If the aforementioned conditions are met, the Site will reimburse the Customer for all sums incurred by him when ordering the returned Products, with the exception of return costs. For operational reasons, the refund will be made within 14 days of the date of receipt of the returned goods.

In a sale with a premium, the Customer undertakes to return the premium to the Site with the returned Product, failing which, the Site will invoice the Customer for the cost of the premium.

LIMITATIONS OF LIABILITY

Figaret Paris is only bound by an obligation of means. The Customer remains the sole judge of the appropriateness and suitability of the items he orders for his needs and consumption.

Figaret Paris cannot be held liable for any use of the Products not in accordance with their intended purpose.

Figaret Paris cannot be held responsible for (i) the loss, alteration or fraudulent access to the Customer's personal data, (ii) the accidental transmission of viruses or other harmful elements, resulting from Internet access or electronic mail transmissions.

Figaret Paris does not guarantee that the Site will be available continuously, without temporary interruption, without suspension or without error.

Without limiting the scope of the other provisions of the General Conditions of Sale, Figaret Paris can only be held liable in the event of proven fault being exclusively attributable to it. In any event, it will be limited to direct damage only.

Figaret Paris reserves the right to suspend the operation of the Site.

PERSONAL INFORMATION

The provision of personal information collected in the context of distance selling is mandatory, this information being necessary for the processing and delivery of orders as well as for the preparation of invoices. This information is strictly confidential. The lack of information implies the automatic rejection of the order. In accordance with the law n ° 78-17 of January 6, 1978 relating to data processing, files and freedoms, the processing of personal information collected on the Site has been declared to the National Commission for 'Informatique et des Libertés, registered under the declaration number 1693756. The Customer has the right to access, modify, rectify and delete data concerning him. To exercise this right, the Customer must send us an e-mail.

The Customer may receive e-mails from the Site with information on the Products and activities of Figaret Paris. The Customer retains the right to refuse a posteriori such communication either by not giving his consent when creating his customer account, and at any time in the account management pages, or by clicking on the unsubscribe link d '' an information email, or by sending us an email.

MAJOR FORCE

Figaret Paris cannot be held responsible for the total or partial non-performance of its obligations, if this non-performance is due to a fortuitous event or to the occurrence of an element constituting force majeure such as in particular, and without this either a limited list, flood, fire, storm, lack of raw materials, transport strike, partial or total strike, or even closure of the company during a strike. These events constitute a cause for the suspension and / or termination of the obligations of Figaret Paris towards the Customer, without compensation for the benefit of the Customer.

PROPRIÉTÉ INTELLECTUELLE

The intellectual property rights attached to the Products sold on the Site are and remain the exclusive property of Figaret Paris. All exploitation rights are reserved exclusively for it. Under these conditions, no one is authorized to reproduce, exploit, distribute or use for any purpose whatsoever, even partially, the intellectual property rights, without the prior written consent of Figaret Paris. Figaret Paris brands and logos are registered trademarks. Any reproduction constitutes, therefore, an infringement.

COOKIES

When consulting the site, information relating to the browsing of Customers may be recorded in "Cookie" files installed on their terminal (computer, tablet, smartphone).

These cookies are issued by Figaret Paris in order to facilitate navigation on the Site and make it possible to recognize the Customers' browser when they are connected to the Site.

It is recalled that the Internet user can oppose the recording of "cookies" on his terminal by configuring his Internet browser software in this way. To this end, it is recommended that he refer to the user manual ("help" section of the browser toolbar) of his internet browser software or obtain any useful information from the publisher of said software. .

ENTIRE CONTRACT

The General Conditions of Sale, the General Conditions of Use and the summary of the order sent to the Customer form a contractual whole and constitute the entire contractual relationship between the Parties.

APPLICABLE LAW - DISPUTES

These General Conditions of Sale and the contractual relations between the Parties are governed by French law. Any dispute arising from the application or interpretation of the General Conditions of Sale is the exclusive jurisdiction of the courts within the jurisdiction of Paris.

CONFIDENTIALITY OF PERSONAL DATA

Rights of access, rectification, deletion and opposition to processing

Through the Site, you may be invited to communicate personal data to Figaret Paris, for example in the context of creating a customer account, ordering products or subscribing to the newsletter.

You have a right of access, rectification and deletion of personal information concerning you, as well as the possibility of opposing the processing of this data, which you can exercise at any time by sending an email to the following address : serviceclient@figaret.com.

You also have the right to lodge a complaint with a supervisory authority, in particular in the Member State in which your habitual residence is located, your place of work or the place where the infringement is alleged to have been committed, if you consider that the processing of personal data concerning you constitutes a violation of the applicable regulations.

Management of personal data

Through the Site, Figaret Paris processes the data concerning you which is necessary for the following purposes:

  • Management of your newsletter subscription (subscriptions and unsubscriptions),
  • Execution and monitoring of your product orders made on the Site,
  • Production of anonymous statistics on the use of the Site,
  • Allow access to certain features of the Site.
  • Communicate to you information relating to products and / or services and commercial prospecting messages.

Data retention

The data is kept for a period that does not exceed the period necessary for the purposes for which it was collected:

  • To manage your newsletter subscription: Figaret Paris keeps the data for 3 years from the last contact. In case of unsubscription, Figaret Paris will deactivate the sending of newsletters.
  • For product orders: the data collected is kept for the purposes of executing your order, then for the time necessary to establish proof of a right or a contract; this data may be archived in accordance with the provisions of the Commercial Code relating to the retention period of books and documents created during commercial activities and the Consumer Code relating to the retention of contracts concluded by electronic means.

 Data recipient

Your personal data is intended for the Figaret Paris services concerned by your requests. However:

  • When you order a product on the Site, the personal data you provide as part of the order is sent to Figaret Paris, or its subcontractors in charge of executing said order.
  • In any case, there is no transfer outside Europe and Figaret Paris does not transmit your personal data except:
    • If Figaret Paris is ordered by a judicial authority or any other administrative authority to communicate the information to it, or
    • If you have given your prior consent to share this information.

GIFT CARD

Figaret Paris offers its customers the opportunity to purchase e-gift cards on the website. The Customer pays for the e-gift card online by Credit Card via the Hipay online payment system or via Paypal. If the order relates only to an e-gift card, the shipping costs are free.

The e-gift card is sent by Figaret Paris by e-mail to the recipient at the address indicated by the Customer.

The validity of an e-gift card is 12 months from the date of the order by the Customer. The e-gift card can be spent only on the website, in a single order or in several installments. Any user of an e-gift card will have to pay in addition to the delivery costs attached to his order (excluding the "free shipping" operation).

Purchases made cannot be refunded. They will be exchanged or credited back to the gift card.
